Public Offer Agreement

This document is the official public offer (hereinafter the "Offer") of the Contractor to enter into a service agreement on the terms set out below. The Offer applies to the internet service smm-hub.com (the "SMM Hub" brand). The agreement is deemed concluded from the moment the Customer performs the actions described in Section 7 of this Offer (acceptance).

In this Offer the following terms are used: Contractor — Individual Entrepreneur Volodymyr Volodymyrovych Romanskyi, who provides the Services; Customer — a natural person aged 18 or over who accepts the terms of the Offer; Services — social media promotion services (followers, likes, views, comments, etc.); Website — the website smm-hub.com; Order — a request placed by the Customer for a specific Service.

The relations between the Parties are governed by the applicable laws of Ukraine, in particular the Laws of Ukraine "On Electronic Commerce" and "On Personal Data Protection".

The Contractor undertakes to provide the Customer with social media promotion Services in accordance with the Order selected by the Customer, and the Customer undertakes to accept and pay for such Services. The Services are provided for Instagram, TikTok, Telegram, YouTube, Twitch and other social networks presented on the Website.

The list, content, scope and cost of the Services are defined in the description of the relevant Service on the Website at the time the Order is placed. The Contractor has the right to change the range and prices of the Services; such changes do not apply to Orders that have already been paid.

To place an Order, the Customer selects a Service on the Website, provides the required information (in particular an email address and a link to a public profile or post) and makes payment. Payment is made by bank card in hryvnia via the Monobank payment service. An Order is deemed paid once the funds are received.

Before payment, the Customer must independently verify the accuracy of all entered information (link, volume, type of Service). After payment and the launch of the Order, the fulfilment process is automatic and cannot be cancelled or changed.

By agreement of the Parties, funds may be credited to the Customer's internal account balance for the subsequent payment of Services.

The Contractor undertakes to: provide the Services in accordance with the description of the selected Order; provide support via the contact channels listed on the Website (email [email protected], Telegram, available 24/7); ensure the confidentiality of the data provided by the Customer. The Contractor has the right to engage third parties (service suppliers, payment and technical processors) to fulfil the Order.

The Customer undertakes to: provide accurate and correct data for fulfilling the Order; pay for the Services in a timely manner; not use the Services for unlawful purposes. The Customer confirms that they provide links only to public profiles and posts and that the Contractor never requests passwords to the Customer's accounts. The Customer has the right to receive Services of proper quality and to contact support.

The Services are provided "as is". The Contractor is not liable for the actions of social networks, which operate under their own rules and beyond the Contractor's control. The Customer assumes the minor risk of natural drop-off (unfollows) on the part of social networks.

A refund is possible if the Order cannot be fulfilled by the Contractor — funds are returned to the Customer's internal account balance or by the same method used for payment. A refund is not provided for Services that have already been performed, nor in the case of an error in the data provided by the Customer.

The Customer agrees not to initiate a chargeback (forced payment reversal) for paid and performed Services. Any fraud, in particular the use of someone else's or a stolen card, results in account blocking without a refund and may serve as grounds for contacting law enforcement authorities.

To provide the Services and process payments, the Contractor engages third-party processors: card payments — Monobank; email delivery — Mailgun; infrastructure and CDN — Cloudflare; online chat — JivoChat; web analytics — Google Analytics. Personal data is not shared with third parties for marketing purposes.

Acceptance (full and unconditional acceptance) of the terms of this Offer is deemed to be the placing and payment of an Order by the Customer on the Website. By performing these actions, the Customer confirms that they have read all the terms of the Offer, fully understand them and agree to them.

By placing an Order, the Customer confirms that they are at least 18 years old and have full legal capacity to enter into this agreement. The Contractor reserves the right to amend this Offer; the current version is always published on the Website, and continued use of the Website signifies the Customer's agreement with the updated terms.
